Vienna Robbery Lawyer

Defending Clients Throughout Northern Virginia

Robbery is a serious offense in the Commonwealth of Virginia. One of the many consequences of being charged with robbery in Virginia is that such a charge creates a legal presumption precluding the accused from being granted bail. Furthermore, being convicted of robbery can result in incarceration and a lifelong criminal record, which can affect the accused’s future ability to obtain employment, housing, and loans.

Because these charges are so serious, it is critical that you seek effective legal representation if you or your loved one has been accused of robbery anywhere in Virginia. The award-winning Vienna robbery attorneys at Portner & Shure, P.A. have been aggressively defending individuals accused of robbery in Northern Virginia for more than 30 years and have a proven record of success.

Virginia Robbery Law

The Commonwealth of Virginia does not have a specific written law for robbery; instead, robbery is a form of larceny under Virginia law. The main difference is that robbery involves force.

Robbery is defined as the taking and carrying away of another person’s property with the intent to permanently deprive the victim of their property by force or threat of force. “Force” includes beating, strangulation, suffocation, or other violent acts. “Threat of force” includes placing another in fear of serious bodily harm or threatening the use of a firearm or another deadly weapon.

Robbery is a felony under Virginia law and carries a maximum penalty of life in prison. Additionally, robbery carries a minimum sentence of five years in prison.

Defenses to Robbery Charges in Virginia

Due to the high potential for violence and bodily harm, the Commonwealth’s Attorney treats robbery cases seriously. However, it is important to remember that individuals who are accused of any crime are entitled to the legal presumption of innocence. Accordingly, the Commonwealth’s Attorney must prove each element of a robbery charge beyond a reasonable doubt in order to prove your guilt.

A review of the evidence may reveal certain weaknesses in the Commonwealth’s Attorney’s case. For example, the Commonwealth’s Attorney may lack sufficient evidence that identifies the accused as the perpetrator. Along with this, the Commonwealth’s Attorney may lack evidence of the use of force or threat of force by the accused. Finally, the Commonwealth’s Attorney may lack evidence of intent.

While these are possible defenses to robbery charges, each case is different—there is no one-size-fits-all solution when it comes to your defense. In order to learn more about possible defense strategies for your specific charges, reach out to our Vienna robbery defense lawyers today.
