The Commonwealth of Virginia has two trial courts. The General District Court is authorized to hear misdemeanor criminal cases. However, there are no jury trials in the General District Court. The Circuit Court has jurisdiction to hear felony cases and de novo appeals from the General District Court. Jury trials are held in the Circuit Court.

The Commonwealth of Virginia divides criminal offenses into felonies and misdemeanors. The difference between a felony and a misdemeanor is the amount of jail or prison time a person can receive upon conviction and sentencing. Historically, misdemeanor crimes carried a maximum of one year in jail while felonies carried a minimum of one year and one day in prison, but felonies can now lock you away for multiple life sentences.
There are six classes of felonies and four classes of misdemeanors in Virginia. As the class escalated in severity, the penalties will increase, too.

A criminal conviction is a finding of guilt on a particular criminal charge. Despite being charged with a crime, an individual is presumed to be innocent and does not have to prove their innocence. Instead, the Commonwealth’s Attorney has to prove an accused individual’s guilt beyond a reasonable doubt.
Another common misconception is that police officers and prosecutors are friends of the defendant. They are not. In fact, police officers and prosecutors may try to manipulate or intimidate people into surrendering or waiving their constitutional rights as someone who has been criminally accused.
