Elements of a Personal Injury Claim
The legal elements of a personal injury claim are duty, breach, causation, and damages. A victim has a prima facia personal injury case when another person’s negligence caused them to suffer an injury.
For example, all automobile drivers owe each other a duty of care. When an automobile driver performs an act of negligence, such as failing to stop for a stop sign, the failure to stop at the stop sign is a breach of their duty.
