Facts: The Plaintiff was a passenger in the vehicle of the Defendant when the Defendant lost control of his vehicle and crossed over the center line and struck another vehicle head on.  The Plaintiff died as a result of the accident.  For confidentiality purposes the names of the parties cannot be disclosed.

Suit was filed and a verdict was rendered to the Plaintiff in the amount of $8,588.00.

Facts: Plaintiff’s medical expenses were approximately $5,000 and the injuries were soft tissue.  However, the Defendant was intoxicated at the time of the accident and had a blood alcohol concentration over .15.  The law in Virginia is that under those circumstances punishment or punitive damages can be awarded.  As a result, punitive damages were demanded.  A list of cases that recently awarded punitive damages were given to the adjuster, including one case in the same jurisdiction, Virginia Beach, Virginia.  The Defendant’s poor driving history and record was also pulled, and provided to the adjuster.  The case settled for $45,000.

Complex Issue: The policy was only $100,000.00 and the defendant had no additional assets.  Client netted, however; two thirds of the settlement amount.
