Facts: Plaintiff’s medical expenses were approximately $5,000 and the injuries were soft tissue. However, the Defendant was intoxicated at the time of the accident and had a blood alcohol concentration over .15. The law in Virginia is that under those circumstances punishment or punitive damages can be awarded. As a result, punitive damages were demanded. A list of cases that recently awarded punitive damages were given to the adjuster, including one case in the same jurisdiction, Virginia Beach, Virginia. The Defendant’s poor driving history and record was also pulled, and provided to the adjuster. The case settled for $45,000.
